Webster Szanyi attorneys Tom Lane and Steve Hamlin recently obtained a decision and award dismissing a significant product liability lawsuit filed against one of the firm’s long time clients, FCA US LLC. In Edwards v. FCA US LLC, 2020 WL 5232077 (N.D.N.Y. Sept. 2, 2020), the firm filed a pre-answer motion to dismiss in the United States District Court, Northern District of New York. The motion was based on arguments that New York courts lack personal jurisdiction where the subject vehicle, a 2016 Dodge Ram 2500, was not manufactured or first sold in New York. On September 2, 2020 the Federal District Court agreed with all of the arguments made by the firm, granted the motion, and dismissed the lawsuit. The dismissal in Edwards is the latest in a long string of jurisdictional victories Webster Szanyi has obtained in favor of its product manufacturer clients.
