On February 12, 2015, the Arbitration Appeals Committee of the National Grain and Feed Association (“NGFA”) affirmed a Decision and Award in favor of Webster Szanyi, LLP’s client, Cargill, Incorporated (“Cargill”), which ruled in favor of Cargill on all of plaintiffs’ claims and further ordered plaintiffs to pay Cargill in an amount equal to all outstanding invoices. Plaintiffs sought in excess of $2 million on their breach of contract and personal injury claims.
The action was originally filed in New York State Supreme Court, County of Niagara, in 2010. Webster Szanyi LLP successfully removed the action to the United States District Court, Western District of New York, where it obtained a stay of the federal litigation pending NGFA arbitration pursuant to a written agreement between the parties.
