The lawsuit, which was filed in the District Court for the Western District of New York, alleged that the plaintiff was discriminated against in connection with a municipality’s decision to hire another applicant for a position, and that she was retaliated against after filing an internal complaint. The plaintiff was a long-time employee of the municipality and applied for a position as the head of her department. A different applicant was hired, and thereafter, the plaintiff was subject to various counseling and reprimands. Ryan Smith represented the municipality in the litigation. Despite the Plaintiff’s long tenure with the municipality, the Court agreed that the plaintiff failed to establish a prima facie case of discrimination or retaliation, and that the municipality presented legitimate, nondiscriminatory reasons for the challenged actions. As a result, the Court granted the municipality’s motion for summary judgment and dismissed the Complaint in its entirety.
