Asbestos

The attorneys of Webster Szanyi have over fifteen years experience representing clients in asbestos related cases.  We have represented several railroads and defended all types of multiple asbestos related claims brought by railroad employees, typically under the FELA.  Many of the claims in the railroad context have involved allegations of exposure through friction (i.e. from brake pads, brake shoes, clutch plates, etc.), exposure to asbestos in the steel making process, and from insulation being removed/installed on pipes around the railroad facilities.  These cases have included claims ranging from asbestosis to asbestos related cancers, including mesothelioma.

Our firm’s attorneys have also successfully represented a wide spectrum of clients outside of the railroad context and in all phases of asbestos related litigation (i.e. discovery, depositions, product identification, trial, etc.).  These clients include:
  • A pump manufacturer
  • A door and window manufacturer
  • Retail suppliers of hardware and construction equipment
  • A manufacturer of roofing materials
  • An automobile manufacturer with allegations relating to exposure from brake pads and gaskets
  • A large corporation in a case where the employee of an outside contractor alleged exposure at the company's plant; and
  • Tractor and motorcycle manufacturers where the claims were brought by repair mechanics alleging exposure from work on brake pads, clutch plates, and gaskets

In each of these cases, our practitioners worked closely with each client to develop and implement the litigation strategies determined to be best suited for the client given the pertinent allegations and issues.

Depending on the case, we have taken aggressive positions for our clients and pursued all available discovery and depositions, retained the most qualified experts, and prepared the case for trial as though the client was the targeted defendant.  On the other hand, we recognize that jumping to the front of the line is not always the best strategy in asbestos litigation and a less active approach to the defense can sometimes be more effective.  However, the attorneys of the firm most enjoy those cases where aggressive yet sensible litigation strategies can be employed. We have defended cases where our client was the sole defendant and where our client was one of more than a dozen defendants.  We are uniquely qualified to work with our clients to develop the case strategy that is most appropriate given the situation.
